TERMS AND CONDITIONS FOR USE OF THE WEBSITE

Part 1 - General

1. The Operator

1.1 This Website (“Website”) is owned and administered by the Association of the British Pharmaceutical Industry of 12 Whitehall, London SW1A 2DY (“ABPI”).

2. Acceptance of the Terms and Conditions of use of the Website

2.1 By using this Website you are agreeing to be bound by these Terms and Conditions.  ABPI reserves the right to amend these Terms and Conditions at any time and without prior notice.  You should therefore inspect the Terms and Conditions prior to use of the Website.  If you do not accept the Terms and Conditions you should exit the site.  Any change to these Terms and Conditions shall take effect from the next time you access this Website.

2.2 If any provision of these Terms and Conditions shall be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

3. Availability and changes to the Website

3.1 ABPI may make changes to the content, layout and means of accessing the Website at any time and without prior notice.  ABPI reserves the right to close the Website permanently or from time to time as it sees fit without prior notice. 

3.2 ABPI reserves the right to take such measures as it deems in its absolute discretion to be appropriate to prevent breach of these Terms of Use or breach of any applicable law or regulation including, but not limited to, blocking your access to the Website.

4. Copyright

4.1 ABPI owns all the copyright in this Website including without limitation in all codes, documents, files text, data, graphics, images, designs, devices and their arrangement on this Website.

4.2 Save for any content which is marked as being owned by a third party, you may copy and print extracts or documents from this Website provided:

4.2.1 the resource which you copy is used for your non-commercial use;

4.2.2 any such copies remain subject to the copyright and any disclaimer referred to in these Terms and Conditions;
4.2.3 ABPI is referred to as the source of the resource which you copy.

4.3 Before using or downloading any third party owned content on this Website you must obtain permission from the third party owner.

4.4 Unless otherwise provided in these Terms and Conditions you may not:

4.4.1 Include a link to this Website in any other Website without ABPI’s prior written consent

4.4.2 Incorporate either part or whole of this Website into another Website or electronic publication

4.5 Except as expressly provided above, nothing contained in these Terms and Conditions is to be construed as granting any licence or right in this Website or its content.

5. Exclusion of Liability

5.1 Nothing in this section seeks to exclude ABPI’s liability with regard to death or personal injury in connection with your use of this Website and arising out of the negligence of the ABPI.

5.2 Access to this Website is at your own risk.  ABPI shall not be liable for any damage to the hardware or software installed on the computer you use to access this Website as a result of your access to, or use of, this Website or your downloading of any resource from the Website.

5.3 To the fullest extent permitted by law ABPI accepts no liability whatsoever for any loss or damage whether direct or indirect, consequential or otherwise resulting from whatever cause through the use of or reliance on any information or advice obtained either directly or indirectly from this Website.

5.4 Information provided on this Website has bee n provided in good faith and ABPI uses reasonable care to ensure the information is up to date.  However, ABPI makes no representations or warranties as to the accuracy, completeness or currency of such information.  ABPI disclaims any obligation to update the information and advice featuring on this Website.

5.5 There are hypertext and other links in this Website which, if used, will involve your entering another Website which is not controlled by ABPI.  ABPI accepts no responsibility or liability in respect of your access to, or use of, any Website which is not under its direct control or in respect of any materials posted on such a Website.  The inclusion of any link does not imply endorsement or approval of such a Website.

6. Password

You must keep your password to the Site confidential at all times.  Anyone using your password will be deemed to have done so with your permission and you will be liable for their use of the Site as if they were you.

7. Trademarks

The ABPI device and word, OHE device and word, AMRIC device and word and PhINTO word are registered trademarks of ABPI.  Any use of the said trademarks is strictly prohibited.

8. Governing Law

Use of this Website shall be in accordance with English law.  Any dispute which might arise concerning use of this Website shall be subject to the jurisdiction of the English courts and shall be determined in accordance with English law.


Part 2 – Rules governing the placing of material on the Website by ABPI members


9. Placing of material on the Website by ABPI members

9.1 By placing material for inclusion on the Website (including without limitation questions, ideas, comments, know-how, techniques, abstracts, personal information) you agree:

9.1.1 that such material will not be deemed confidential; and

9.1.2 to licence ABPI free of charge and in perpetuity to use, disclose, copy, modify, adapt, publicly display, translate or otherwise use such material for any purpose and at any place worldwide.

9.1.3 to comply with all applicable laws, statutes and regulations applicable to such placing.

10. Activity which is not permitted

10.1 In posting material on the Website you may not:

10.1.1 misrepresent your identity or status;

10.1.2 knowingly or recklessly post any material containing a virus or something having similar effect;

10.1.3 remove or change the content of any materials posted by other parties; or

10.1.4 post the material in any way suggesting that it is authorised or endorsed or posted by ABPI.

10.2 You must not use material posted by other parties to collect and process other people’s personal data.

10.3 You must not post any content (or post any link to another site containing material) which is:

  • An advertisement or offer to sell goods or services
  • defamatory
  • harassing
  • in breach of confidence or privacy
  • in breach of any intellectual property rights
  • menacing
  • obscene
  • offensive
  • pornographic
  • racist
  • threatening
  • untrue

or otherwise unlawful

11. ABPI rights

11.1 ABPI reserves the right to remove any material posted by you and ABPI members, whether or not in breach of these Terms of Use and to do so without notice and without the need to give a reason.

11.2 ABPI reserves the right to monitor materials which are posted by third parties but accepts no obligation to do so.

11.3 ABPI may disclose information about you and any content posted by you if required to do so by law or ordered to do so by a court of competent jurisdiction. 

12. Legal liability

11.1 Posting of material on the Website by you has potential to give rise to legal liability. If you post material which includes untrue, offensive, defa matory, un true or illegal content, this can lead to a claim against you and possibly also give rise to a criminal charge.  You should only post material on the Website that you would feel comfortable in disclosing to members of the ABPI as a whole, or indeed to the public at large.

11.2 You agree to indemnify ABPI in full for any loss it suffers as a result of any breach of these Terms of Use by you or with your authority.
